1. Definitions
In these Terms and Conditions, the following terms have the meanings set out below:
- "Payung Restu", "we", "us", "our": Payung Restu, a pension protection legal service provider based at No. 3, Persiaran Perbandaran, Seksyen 14, 40000 Shah Alam, Selangor, Malaysia.
- "Services": The legal and advisory services offered by Payung Restu, including the Pension Guidance Session, Ongoing Correspondence Support, and Assistance & Representation.
- "Client", "you", "your": Any individual who accesses this website or engages with us to obtain Services.
- "Website": The website operated by Payung Restu at payungredas.biz.
- "Agreement": These Terms and Conditions, together with any fee agreement or engagement letter entered into between you and Payung Restu.
2. Acceptance of Terms
By using this Website or engaging our Services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Website or engage our Services.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using our Services on behalf of another person (for example, a family member), you confirm that you are authorised to do so and to bind that person to these terms.
3. Description of Services
Payung Restu provides pension protection legal services in Malaysia, including:
- Pension Guidance Session (RM 237): A structured session to review your pension documents, explain your position in plain terms, and set out the options available to you.
- Ongoing Correspondence Support (RM 283): Preparation and submission of correspondence with pension funds or relevant authorities on your behalf, with deadline management and regular updates.
- Assistance & Representation (RM 328): Full case preparation, liaison with all relevant parties, and formal representation at hearings or formal proceedings.
Services are provided primarily to clients located in Malaysia. We may accept enquiries from clients outside Malaysia on a case-by-case basis, depending on the nature of the pension matter.
4. Client Responsibilities
By engaging our Services, you agree to:
- Provide accurate, complete, and up-to-date information relevant to your matter
- Supply any documents or records reasonably requested by us in a timely manner
- Notify us promptly of any changes in your circumstances that may affect your matter
- Review and approve correspondence and submissions before they are sent on your behalf
- Not use our Services for any unlawful purpose or in a manner that would bring Payung Restu into disrepute
You agree not to provide false or misleading information. Doing so may result in the termination of our engagement and may, in certain circumstances, constitute an offence under Malaysian law.
5. Intellectual Property
All content on this Website — including text, design, structure, and materials created by us — is the intellectual property of Payung Restu and is protected under applicable Malaysian law.
You may view and print pages from the Website for your personal, non-commercial use. You may not reproduce, distribute, or republish any part of the Website without our prior written consent.
Documents, letters, and submissions prepared by Payung Restu in connection with your matter remain our intellectual property until all fees have been paid in full. Upon payment, you are granted a non-exclusive licence to use those materials for the purpose of your pension matter.
6. Payment Terms
Fees for each service are as stated on our website and confirmed in writing before work commences. All amounts are in Malaysian Ringgit (RM).
- Payment is due before or at the time of the first session, unless otherwise agreed in writing
- Accepted payment methods will be confirmed at the time of engagement
- If a matter expands beyond the agreed scope, any additional fees will be discussed and agreed before work proceeds
- We do not offer refunds for sessions that have taken place. Where a session has been cancelled with more than 48 hours' notice, a full refund or rescheduling will be offered.
7. Confidentiality
We maintain strict professional confidentiality over all client information. We will not disclose your personal or case information to any third party except: (a) where necessary to advance your matter, with your knowledge; (b) where required by law or a court order; or (c) with your explicit consent.

8. Disclaimers
Payung Restu provides legal advisory and support services. Whilst we take care in everything we do, we cannot and do not make any promise as to the outcome of your pension matter. The result of any formal proceedings or negotiations depends on many factors outside our control, including the decisions of third parties such as pension fund administrators, tribunals, or courts.

9. Limitation of Liability
To the extent permitted by Malaysian law, Payung Restu's total liability to you in connection with any matter shall not exceed the fee paid for the specific service in question.
We shall not be liable for indirect, consequential, or special damages arising from your use of our Services or Website, including but not limited to loss of income or loss of expected pension benefit.
Nothing in these Terms excludes liability for fraud, gross negligence, or any matter that cannot lawfully be excluded under Malaysian law.
10. Indemnification
You agree to indemnify Payung Restu against any loss, damage, claim, or expense (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your provision of false or misleading information; or (c) your use of the Website or Services in a manner that violates applicable law.
11. Termination
Either party may terminate the engagement by giving written notice. If you terminate after work has commenced:
- You remain liable for fees in respect of work already completed or costs incurred
- We will provide you with a copy of all work product to date
We may terminate the engagement immediately if you provide materially false information, instruct us to act unethically, or fail to pay agreed fees after reasonable notice.
Sections relating to confidentiality, intellectual property, liability, and dispute resolution survive termination.
12. Dispute Resolution
In the event of any dispute arising from these Terms or our Services, we encourage you to contact us in the first instance so that we may attempt to resolve the matter informally.
If a dispute cannot be resolved informally within 30 days, it shall be referred to mediation under the Malaysian Mediation Centre. If mediation is unsuccessful, the dispute shall be resolved by the courts of Malaysia.
These Terms are governed by and construed in accordance with the laws of Malaysia, and you submit to the non-exclusive jurisdiction of the courts of Selangor.
13. General Provisions
- Entire Agreement: These Terms, together with any written engagement letter, constitute the entire agreement between us in relation to your matter.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
- Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our written consent.
- Notices: Notices may be given by email to the addresses confirmed at the time of engagement.
14. Changes to These Terms
We may update these Terms from time to time. When we do, the revised version will be published on this page with an updated date. Continued use of the Website or Services after the update constitutes acceptance of the revised Terms.
